1. General

These General Terms of Use (GTU) apply to the website www.wydin.com and the Wydin application. By using them, users unreservedly accept these GTU as well as the General Terms of Service, which are accessible on the website and refer back to the GTU.

The website accessible at www.wydin.com, its domain name, and the Wydin application are the property of WYDIN, a simplified joint-stock company with a capital of €10,000, registered under number 921 024 188 RCS Paris, with its headquarters at 13 rue de Naples, 75008 Paris, represented by its President, who is domiciled in this capacity at the registered office.

"WYDIN" is a registered European trademark with the EUIPO (European Union Intellectual Property Office).

The website www.wydin.com and the Wydin application, in their entirety or in any of their elements (including structure, logos, graphics, and colors), constitute a protected work under the provisions of the Intellectual Property Code.

Any unauthorized reproduction, representation, publication, distribution, transmission, extraction, or exploitation of the website, its elements, or the information it contains is strictly prohibited and may result in legal proceedings, including actions for infringement or unfair competition, as well as civil, commercial, criminal, and/or administrative sanctions.

The databases available on the website are protected under the Intellectual Property Code, meaning that any extraction or reuse of their content may constitute infringement and may result in legal action and sanctions.

Any reference to www.wydin.com in these terms automatically includes a reference to the Wydin application.

Any citation or reuse of the site's content, except for a hyperlink to the site and the WYDIN name, requires prior express written authorization from the Publication Director. In such cases, the source www.wydin.com, the date of copying, and the WYDIN copyright must be clearly indicated.

WYDIN commits to making its best efforts to ensure that users can access the website at all times. However, it cannot be held liable in cases of site unavailability due to causes beyond its control.

The website www.wydin.com is governed by French law.

2. Content Distribution Rules

The USER of the MARKETPLACE agrees to comply with the communication rules and principles outlined below and expressly accepts that any violation of these rules may result in the immediate removal of non-compliant content without compensation.

The USER is strictly prohibited from publishing on the MARKETPLACE or about the MARKETPLACE any content that is offensive, defamatory, derogatory, slanderous, racist, xenophobic, immoral, unethical, infringing, disruptive to public order, or violating the rights of third parties. Any content that could harm the rights, reputation, and image of WYDIN, or that is generally in breach of laws and/or regulations, particularly criminal law, is strictly forbidden.

The USER is allowed to create one or more hyperlinks pointing, for example, to the homepage of the MARKETPLACE or their profile page, but only from lawful websites that do not harm WYDIN’s interests or image, or that of the MARKETPLACE.

WYDIN reserves the right to revoke this authorization at any time if it deems that the link established with the MARKETPLACE could damage its interests, reputation, and/or image.

Under no circumstances does the existence of a hyperlink from a third-party website to the MARKETPLACE imply any cooperation or partnership between the MARKETPLACE and that third-party site. WYDIN has no control over third-party websites and, therefore, assumes no responsibility for the content, products, and/or services available on or through these third-party websites containing a hyperlink to the MARKETPLACE.

3. Reporting Illegal Content and Single Point of Contact

The presence of any content that violates these terms may be reported to WYDIN, which serves as the single point of contact under European Regulation 2022/2065 (the "Digital Services Act"), by contacting the following email address in French or English: contact@wydin.com.

Any illegal content or content violating these terms may also be reported to ARCOM by completing the form available at https://www.arcom.fr/contact.
